Please read these Terms carefully before using our website or engaging our services. By using this website or instructing us to act on your behalf, you confirm that you have read, understood, and agreed to be bound by these Terms.

  • “Client” / “You” — any person who uses this website or engages our services.
  • “Services” — the pension legal services described on this website, including retirement planning consultation, pension authority correspondence counsel, and joint pension matters counsel.
  • “Engagement” — a formal instruction to provide a specific Service, confirmed in writing by both parties.

  • “Agreement” — these Terms together with any engagement letter or scope of work document provided to you.

2. Acceptance of Terms

By accessing this website or instructing us to act on your behalf, you confirm that:

  • You are at least 18 years of age.
  • You have the legal capacity to enter into a binding agreement.
  • You accept these Terms in full.

If you do not accept these Terms, please do not use this website or engage our services.

3. Services

We offer three principal services to individuals with pension matters in Thailand and applicable international jurisdictions:

Retirement Planning Consultation — ฿2,900

A single consultation appointment covering legal review of the client's pension position prior to retirement, including a written summary of findings.

Pension Authority Correspondence Counsel — ฿5,900

Professional assistance in formulating and managing responses to correspondence from pension authorities, including drafting and continued correspondence as required.

Joint Pension Matters Counsel — ฿7,700

A coordinated engagement for couples with interrelated pension matters, beginning with a joint consultation and developing a combined approach for both parties.

The specific scope of each service will be set out in an engagement letter provided before work commences. We do not provide tax advice, financial planning advice, or investment recommendations as part of our services.

4. Client Responsibilities

To enable us to provide services effectively, you agree to:

  • Provide accurate, complete, and timely information as requested.
  • Notify us promptly of any change in circumstances relevant to your matter.
  • Respond to our communications within a reasonable time.
  • Use this website and our services only for lawful purposes.
  • Not submit false or misleading information through our enquiry forms.
  • Ensure that any documents you provide to us are yours to share and do not infringe third-party rights.

5. Intellectual Property

All content on this website — including text, layout, design, and documentation — is the property of Nakhon Counsel or is used with appropriate authorisation. You may access and read the content for your personal, non-commercial use. You may not reproduce, distribute, or republish any content from this website without our prior written consent. 6. Fees & Payment

Service fees are stated in Thai Baht (฿) and are as published on this website at the time of engagement. Payment terms will be set out in the engagement letter. In general:

  • Payment is due upon confirmation of the engagement unless otherwise agreed in writing.
  • We accept payment by bank transfer and other methods as notified to you at the time.
  • Fees are non-refundable once work has commenced, except where a service cannot be delivered due to circumstances within our control.
  • Any additional work outside the agreed scope will be discussed with you before proceeding and will be subject to separate fees.

7. Confidentiality

We treat all information provided to us in connection with your matter as confidential. We will not disclose your information to third parties except with your consent, or where required by law or regulatory obligation. You agree to keep any advice, strategies, or written materials we provide to you confidential and not to share them with third parties without our prior written consent, except as required for the purpose of your own pension matter.

8. Disclaimers

The information on this website is provided for general informational purposes only and does not constitute legal advice. Engaging our services creates a professional relationship; browsing this website alone does not. We do not make any representation that our services will produce any particular outcome. Pension matters are subject to applicable laws, authority decisions, and individual circumstances that lie outside our control.

This website is provided on an “as available” basis. We do not warrant that it will be free of errors, interruptions, or security vulnerabilities. We reserve the right to amend or withdraw content at any time without notice.

9. Limitation of Liability

To the extent permitted by applicable law, our total liability to you in connection with any service engagement shall not exceed the fee paid for that engagement. We shall not be liable for:

  • Indirect, consequential, or incidental loss or damage.
  • Loss of income, opportunity, or anticipated savings.
  • Decisions made by pension authorities or third parties.
  • Delay or failure caused by circumstances beyond our reasonable control (force majeure), including government action, natural events, or system failures.

10. Indemnification

You agree to indemnify and hold harmless Nakhon Counsel, its principals, and team members from any claim, loss, damage, or expense (including reasonable legal costs) arising from your breach of these Terms, your use of the website in an unlawful manner, or your provision of inaccurate or misleading information in connection with an engagement.

11. Termination

Either party may bring an engagement to a close by giving written notice to the other. In the event that we cease work at our discretion for reasons including non-payment, provision of false information, or conduct that makes it impracticable to continue, we will notify you in writing. Fees for work completed up to the date of termination will remain due. Sections 5, 7, 9, 10, and 12 survive the termination of any engagement.

12. Dispute Resolution

These Terms are governed by the laws of Thailand. In the event of a dispute, the parties agree to first attempt informal resolution by notifying us at [email protected]. If the matter cannot be resolved informally within 30 days, disputes shall be subject to the jurisdiction of the courts of Thailand. We welcome feedback and will endeavour to address concerns promptly and in good faith.

13. General Provisions

  • Entire Agreement: These Terms, together with any engagement letter, constitute the entire agreement between the parties in relation to the subject matter.
  • Severability: If any provision is found to be unenforceable, the remaining provisions continue in full force.
  • Waiver: A failure to enforce any provision does not constitute a waiver of that right.
  • Assignment: You may not assign your rights under these Terms without our prior written consent.
  • Notices: Formal notices should be sent in writing to the address or email given in these Terms.

14. Changes to These Terms

We may update these Terms from time to time. The revised version will be posted on this page with an updated “Last Updated” date. For existing engagements, material changes will be communicated to you directly. Continued use of this website following any update constitutes acceptance of the revised Terms.
